REGULATIONS FOR THE PROVISION OF ELECTRONIC SERVICES AND DISTANCE SALES

§1 General provisions and definitions

  1. These Regulations define the rules for using the website, the rules for providing services by electronic means, and the rules for concluding distance contracts.

  2. The Regulations have been prepared in accordance with:

  • the Act of 18 July 2002 on the provision of services by electronic means;

  • the Act of 30 May 2014 on consumer rights;

  • the Act of 23 April 1964 – the Civil Code.

  1. Whenever the Regulations refer to:
    Consumer – it means a natural person entering into a contract not directly related to their business activity.
    Digital Content – it means data produced and delivered in digital form.
    Service – it means an online consultation provided by the Foundation.

§3 Scope of services provided

  1. The Foundation provides:

  • online psychological consultations;

  • sale of digital content (courses, recordings, educational materials);

  • the possibility to make online payments;

  • the possibility to make voluntary donations.

  1. A detailed description, price and duration of access to digital content are indicated each time on the offer page.

§4 Technical requirements

  1. To use the website, the following are required:

  • a device with Internet access;

  • an active e-mail account;

  • an up-to-date web browser.

  1. The Foundation is not responsible for incompatibility of the user’s equipment with the technical requirements.

§5 Pre-contract information
Before concluding a contract, the Consumer receives information regarding:

  • the main features of the service;

  • the total gross price;

  • the method and time of performance of the service;

  • the duration of the contract or access to digital content;

  • the right to withdraw from the contract and its limitations.

§6 Conclusion of the contract

  1. The contract is concluded when the Consumer receives confirmation of acceptance of the order by electronic means.

  2. The condition for concluding the contract is:

  • acceptance of these Regulations;

  • successful payment.

  1. Prices are given in Polish zloty (PLN).

  2. The Foundation does not process or store payment card data.

§7 Payments and electronic invoices

  1. Payments are made through payment operators.

  2. The obligation to pay arises when the order is placed.

  3. The Foundation issues invoices in accordance with applicable tax regulations.

  4. The invoice is delivered in electronic form.

  5. Acceptance of these Regulations constitutes consent to receive invoices electronically.

§8 Right to withdraw from a distance contract

  1. The Consumer has the right to withdraw from the contract within 14 days without giving any reason.

  2. The period is calculated from the date of conclusion of the contract.

  3. The declaration of withdrawal may be submitted electronically.

  4. The refund of payment is made no later than 14 days from the receipt of the declaration.

Exceptions to the right of withdrawal
The right of withdrawal does not apply in the case of:

  • services fully performed with the express consent of the Consumer;

  • services that have begun before the withdrawal period has expired;

  • digital content delivered before the expiry of 14 days if the Consumer agreed and was informed about the loss of the right of withdrawal.

§9 Compliance of digital content with the contract

  1. The Foundation undertakes to deliver digital content in accordance with the contract.

  2. Digital content is considered compliant with the contract if it:

  • corresponds to the description and functionality indicated in the offer;

  • is suitable for ordinary use;

  • is complete and free from defects.

  1. In the event of non-compliance, the Consumer has the right to request:

  • bringing the content into compliance;

  • a reduction in price;

  • withdrawal from the contract in accordance with the consumer rights law.

§10 Cancellation of consultation

  1. A consultation may be cancelled no later than 24 hours before the scheduled time.

  2. In the absence of cancellation, the fee may be retained as compensation for the reserved appointment.

§11 Nature of the services provided

  1. Consultations are educational and psychological in nature.

  2. They do not constitute medical services.

  3. In situations threatening life or health, appropriate emergency services should be contacted.

§12 Minors

  1. Persons under the age of 18 may use the services only with the consent of a legal guardian.

  2. The contract is concluded with a parent or legal guardian.

§13 Donations

  1. Donations are voluntary and non-refundable.

  2. A donation does not constitute a reciprocal service.

§14 Complaint procedure

  1. Complaints may be submitted electronically.

  2. A complaint will be considered within 14 days.

  3. The Consumer has the right to use out-of-court dispute resolution methods and the EU ODR platform: https://ec.europa.eu/consumers/odr

§15 Personal data protection
The rules for processing personal data are defined in a separate Privacy Policy.

§16 Liability and force majeure
The Foundation is not responsible for failure to perform obligations resulting from force majeure.

§17 Intellectual property
Content made available on the website is protected by law. Copying it without the consent of the Foundation is prohibited.

§18 Changes to the Regulations

  1. The Foundation may amend these Regulations for important legal or organizational reasons.

  2. The changes do not affect the acquired rights of Consumers.

  3. The changes come into force on the date of publication.

§19 Information about the right to withdraw from the contract
The Consumer has the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires after 14 days from the date of conclusion of the contract. To exercise the right of withdrawal, the Consumer must inform HANT Foundation – Institute of Psychohygiene and Neurodiversity, 27 Stycznia 4, 62-065 Grodzisk Wielkopolski, Poland, e-mail: hantfundacja@gmail.com, about their decision to withdraw from the contract by means of a clear statement (for example, an e-mail message). The refund of payment will be made no later than 14 days from the receipt of the declaration.
